A Policy Quick-Take
The government has no authority to grant, dissolve or regulate voluntary marriage contracts except upon ordinary civil process initiated by one of the parties.
The right to an unimpaired voluntary contract is a Constitutionally protected right.

Marriages are voluntary contracts; the terms of each contract are the law of that contract.


Marriage between free People is a common-law, civil contract.
The government is prevented from interfering with contracts that are not inherently criminal agreements.

Religious marriage between free People is a common-law, civil contract.
The Congress is forbidden to interfere in religion and practice, so long as the practices are not inherently criminal. Religious contracts, such as marriage, are protected from Congressional meddling by both the contracts clause and the 1st amendment.
